Construction Noise

Construction projects are generally of limited duration but may still give rise to unacceptable noise, particularly if the works are close to residential properties or occur at night and weekends.

It may be beneficial for the contractor to make a Prior Consent application to the local authority. This allows the contractor to identify the plant he proposes to use, the operational methods and noise mitigation measures to be employed, and the predicted noise levels at sensitive properties.

If the local authority is satisfied that the contractor will employ the Best Practicable Means to minimise noise, they will grant Consent under provisions in Control of Pollution Act 1974. A Consent gives the contractor freedom to proceed with works without risk of nuisance proceedings, providing he complies with the measures and requirements in the Consent.
